ZCZCPRI COM ECO ESPL.NEWDELHI DCM25 SAHARA Sahara victimised for years, but won't give up: Subrata  Roy New Delhi, Apr 11 (PTI) Facing a possible auction of his personal and company assets by Sebi, a defiant Sahara chief Subrata Roy says he feels victimised by a chain-reaction of events over the years that began with a political vendetta in2005, followed by regulatory clampdowns by RBI and Sebi.  "It started as a political vendetta against us in 2005, and thereafter it became a chain reaction. First RBI took actions against us in 2008 and thereafter Sebi clamped down on our businesses," said head of diversified conglomerate Sahara group that has presence in entertainment, real estate, financial services and hospitality businesses, among others.    Speaking to PTI over telephone, Roy said that the other businesses of Sahara group were getting affected because of Sebi's actions, but he was ready for a "fight to finish" and confident of the matters being resolved in due course.  Roy was summoned by the market regulator Sebi yesterday to ascertain details of his personal and two company assets that could be sold to generate over Rs 24,000-crore worth funds required to be returned to the investors.  Sebi has charged Sahara India Real Estate Corp Ltd(SIRECL) and Sahara Housing Investment Corp Ltd (SHICL) of “various illegalities" in raising these funds. The Supreme Court has asked Saharas to return this money to over three crore bondholders, while Sebi has been asked to facilitate the refund after verifying genuineness of the investors.    A combative Roy claimed that his group has been target of personal vendetta by "certain" officials from RBI and Sebi.  Sahara chief further said that 60 per cent of his time has been wasted in fighting Sebi in last two years, which could have been otherwise utilised for "some constructive work".    "We have suffered a lot because of this," he said.    Asked whether he felt victimised, Roy said: "Definitely, we are. We have been the target of Sebi for no reasons."    He, however, ruled out any political conspiracy at play in the current scenario and said that the politics was at playing problems created for his group way back in 2005.  "Today, the issues being raised against us do not appear to be linked to the original political matters of 2005," he said, but refused to specify what those issues were, saying it was an old matter and should not be raised at this time.   Roy has often been described as being close to various political leaders, especially those from Uttar Pradesh.    He also denied the allegations of his group companies being used to launder the funds of rich politicians and others and dared the "entire system" to prove even one case of fictitious investor accounts or money laundering.    After appearing before Sebi last afternoon, Roy told the waiting reporters that his personal assets were worth only about Rs three crore and he had no immovable properties.     Roy, who generally keeps away from direct media glare and has been lately communicating his and group's views through full-page newspaper advertisements, surprisingly talked at length to the media persons, who had gathered in large numbers outside the Sebi headquarters in Mumbai. NEWDELHI DCM26SAHARA 2 LAST striking a defiant pose, Roy accused Sebi of delaying the refund by not distributing the money deposited with it.  Sahara group claims that it has returned bulk of the investors directly and its total outstanding liability was much less than Rs 5,120 crore it has already deposited with Sebi, but these claims have been questioned by the regulator.    "My point is that we only gave the figure of Rs 24,700crore for the funds raised by Sahara companies and we gave these figures on our own.  "If they believed us on that figure, why do they not believe us when we say that we have repaid most of the investors and the total outstanding is much less than Rs 5,120crore deposited with Sebi for the refund," he said.    "If we are proven wrong, we should be hanged, but the same should apply to others as well. If others are found to be wrong in this matter, they should also be hanged," he said.    When asked whether he expected regulatory actions against Sahara group's retail venture Q-Shop as well, Roy said: "Not at all, Q-Shop is a purely non-financial business and it should not face any problems." Admitting that other businesses were getting affected due to tussle with Sebi, Roy said: "We will fight it till we take it to the logical conclusion and I would not give up.  "People tell me that why I'm fighting always, but I have no other option. I will fight till my last breath. We have grown this business like a family. There are 10 lakh people and they are my family."    Clamping down on Sahara's residual non-banking operations in 2008, RBI had asked it to stop collecting deposits under this business and return the money already garnered. This was followed by Sebi's actions in 2010 against money raised by two Sahara firms through bonds known as OFCDs (Optionally Fully Convertible Debentures).    After the Sahara firms failed to deposit the entire amount of over Rs 24,000 crore collected through OFCDs, Sebi has gone ahead with attachment orders of bank accounts and assets.  "As per the law, Sebi cannot sell any assets. They do not have the powers. The court relates to attachment of assets of only two companies, and that too through a proper judiciary mechanism, and not the assets of mine and others," he said.    Asked about the allegations of money laundering, fictitious investors and handling the money of politicians, Roy said: "People say these things, but I challenge the entire system to look into the matter and prove even one single fictitious account or any single paisa of money laundering." Roy maintained that he was hopeful that the matters would-be "resolved for good".    "I am a strong believer in truth and truth can be troubled and suppressed, but it cannot be defeated," he added. Sebi wasting time, says Sahara's Subrata Roy


Yesterday, Managing Worker & Chairman of Sahara India Pariwar, Shri Subrata Roy Sahara with Smt. Vandana Bhargava, Shri R.S. Dubey and Shri Ashok Roy Choudhury attended SEBI’s office since SEBI had summoned them.

They presented the details of their personal assets. Shri Subrata Roy’s personal assets were around Rs 3 crore only.

Shri Subrata Roy requested and conveyed his grave concern that unmatured accounts should get their money back for which Sahara has already paid Rs. 5,120 crs to SEBI and SEBI has not taken any initiative.

He also requested that SEBI should take all possible initiatives to accelerate repayments and verifications of documents.

Shri Subrata Roy, on coming out of SEBI’s office spoke to the waiting press and declared his firm faith that nobody on this earth can prove RIGHT as wrong and said SEBI is only fighting everyday to get more money from Sahara. It is orchestrating leaks to press because of which Sahara is facing media trial regularly. Whereas in last 7 months, not even one step has been taken towards repayment of remaining investors or towards verifications of documents.

The fact of repayment is that Sahara has already repaid the entire liability except around Rs. 5,120 crs to its investors before 31st August 2012. This means that all repayments by Sahara were done before the Judgement of Hon’ble Supreme Court.

While leaving the SEBI office, Shri Roy speaking to the media, said with a smile that the Company has paid Rs. 5,120 crs to SEBI and all the expenses are on Sahara’s account, so it was unfortunate that during the meeting, they weren’t even offered a cup of tea by the SEBI officials.

Sahara Group says Enough is Enough


FOR ABSOLUTELY NO FAULT OF OURS ALL, SEBI is continuously damaging Sahara"s hard earned, clean image, reputation and goodwill earned in last 34 years, by deliberately farming wrong orders and leaking them to press and electronic channels. Such malafide acts completely destroy the credibility of SEBI and show clearly that it is acting under the diktata of powerful third parties, who are determined irreparable damage to sahara.
SEBI is deliberately doing absolute wrong to us- to 10 Lac worker's families, to crores of small esteemed investors, who do not go to the bank and neither does the bank and neither does the bank go to them.

Enough is Enough , I hereby challenge and invite the chairman or/and Members or/and Executive Directors of SEBI for a live debate withme on a TV channel and let people know their wrong intent and deed, as a corporate

I solicit and invite SEBI for such a Live Debate and for that, to let us know a specific date which may be suitable to them, with a request of giving at least 10 days notice for organizing the appropriate channel and necessary time slot of 60 minutes on TV channel.
I myself will sit to expose the truth as it is my moral duty being a responsible citizen of India and also responsible for Crores and Crores of Esteemed Investors and 10 Lac workers of Sahara

Many many crores families of Hon'ble Depositors, Investors, Customers and lakhs of workers (in all, around 28 crores citizens of India) have no problem, no grievance against sahara, than why does the regulator/system have it?

I also wonder why SEBI is talking about my detention. I would like to clarify that even if SEBI intends to force me out of the country, they are never going to succeed. I can never even think of that. I love my country and I will always live in my last breath.

Whatever fight I have to go for, I will. My father always taught me not to do wrong, not to render injustice to anybody and neither ro accept injustice or wrong from anybody.
Rather, I need to say something to the chairmen of SEBI. I have personally written to him thrice seeking an appointment. Till date, however, my request has not been entertained.
I emotionally appeal my beloved countrymen to come forward and kindly help 10 Lac Abiding, Disciplined, Absolutely Honest, Dedicated 'Bharat Maa' Loving people of India.
Since, last 34 years we have always very respectfully and genuinely said that our judiciary is above board and we have immense respect and faith in our judical system.

In this case, SEBI has, all along given misleading and mischievous information, and twisted interpretation of Law. Well temporarily they are trying to be a winner but we hope truth will triumph, when records of refunds will be verified as the right thing ultimately be right and it can be proved wrong. Also a wrong cannot ultimately be proved right.
Shri B.N Agarwal was appointed on 31st May 2012 by the Hon'ble supreme Court oversees proper compliance. We have requested Shri Agarwal telephonically as well as in writing many times but he has always declined to meet anybody from Sahara till today.
Now after this, he has written so much against Sahara which has been submitted by SEBI to the Hon'ble Supreme Court on the 15th March 2013. I.A

SEBI’S Malicious Act
Everyday, SEBI is malolusly leaking to media (reason best known to SEBI), one or the other news, without any substance, against Sahara Group, to wreak personal vengeance ...by some officers involved in handling with the matter.

Now, In order to make further media publicity, SEBI has filled another status report and IA In the Supreme Court and even before mentioning the matter in the Horible Court, SEBI has supplied copy of the petitions and such reports to media, propagating the news about civil detention of the promoter and directors of the company. Ironically, the matter was mentioned before the Honorable Supreme Court and Honorable Court did not find any urgency and advised for listing of the matter in due course, after Holi vacations, SEBI is incorrectly seeking Civil Detention despite being well aware of the provision of law, which does not permit any such process. In a case of this nature and as under the SEBI Act, application of C>P>C is clearly barred and ruled out and also the fact that no question of any such non-compliance, on the part of Sahara officials do arise in view of the entire unpaid amount having been deposited with SEBI and the records of redemption made submitted to them for verification.

SEBI is not only providing false information to the Media, it has also hidden truth from the citizens of this country. Sahara has deposited TDS on the interest paid to the investors on behalf of the two Sahara Companies with the Income Tax Authorities. The TDS deposited is more than Rs.700 crores. These true facts are never reported to the Media by SEBI

ABOUT SEBI'S ONE RECENT ALLEGATION
"Out of the thousands of Sahara Investors, SEBI finds only 68 genuine investors"
SEBI's recent allegation is that there are few thousands investors who have not responded. SEBI should be wise enough to understand that all small investors who have already received payment shall definitely not correspond with SEBI or anybody for that matter. Allegation is absolutely baseless, concocted, unverified, malicious and in clear disregard of the Directions No.7 of the judgement dated 31.08.2012 passed by the Hon'ble Supreme Court, which reads -

"SEBI (WTM), in the event of finding that the genuineness of the subscribers is doubtful, an opportunity shall be afforded to Saharas to satisfactory establishes the same as being legitimate and valid. It shall be open to the Saharas in such an eventuality to associate the concerned subscribers to establish their claims. The decision of SEBI (WTM) in this behalf will be final and binding on Saharas as well as the subscribers."

SEBI knows since we have written so many times that millions of very small investors run their tea stalls, are small vendor’s etc.etc. Who are on highways. Millions of Rural people do not have House No., Mohalla etc. There are large numbers of small investors who do not own their houses and accordingly have shifted their address from time to time.
Our agent- introducers/office staff knows them very well and can arrange meeting any time with any authority, wherever and whenever required. You may point out any of the investors and our workers can produce them or enable you to reach them without any difficulty as they provide service to these investors on regular basis.

We challenge SEBI to find or prove even one fictitious investor.
However, SEBI has without giving us any such opportunity, though required to do so, has instead straightaway hurled these baseless and one sided allegations.

Should SEBI under any need, under any law, under any logic, under any Hon'able Court's Direction attach group Chairman's and 3 Directors properties, bank accounts, etc.etc? NO, THEY DON'T HAVE ANY REASON OR RIGHT. 

Rich men’s SEBI does not understand, recognise poor Investors


Sahara complained that SEBI Chairman Sri U.K. Sinha neither gave time to meet our Chairman since last one year nor he accepted the invitation for appearing with our Chairman in T.V. Channel for informing people the truth and torture given to Sahara. Such a big responsible person should not give irresponsible statements that how and why Rs.20,000 crores repayments were made in 4 months and 90% was paid in cash.  Well, he should have asked these questions to Sahara first.

Repeatedly we have written to SEBI and everywhere that our investors are very small and mostly living in small townships and rural areas. These investors do not go to Banks and Banks do not come to them.

Our investors profile on the basis of principal amount.

Upto Rs. 5, 000/- = 1.33 crores, upto Rs.10,000/- another  0.88 crores, upto Rs.15,000/- another 0.42 crores, upto Rs.20,000/- another 0.36 crores. This totals to 2.99 crores out of total investors of 3.07 crores. We genuinely hope that the SEBI Chairman should kindly send an amended statement to Media with realisation and apologies that why cash repayments to around 90% investors have been made and the 90% cash payments are totally justified.

Upto Rs. 20,000 repayments (including interest) it is cash payments only as per country’s law.

 It should also be clear that 90% amount of investors in both the companies have come from investors upto Rs.20, 000 that is 2.99 Crores. So any logical but unbiased mind shall be convinced, accept and understand our challenge in the past also that there cannot be any case of fictitious, fake investors in Sahara.

He has also mentioned about paying Rs. 20,000 crores in 4 months. But majority payments are in 5 months plus time.

SEBI knows the reason very well that upto April 2012, esteemed investors through our committed and highly concerned field workers in Lakhs, knew that Hon’ble Supreme Court is likely to give 5 – 6 years against security of properties. We have submitted the valuation reports of properties to Hon’ble Supreme Court.

In fact in case of RNBC under regulation of Reserve Bank in 2008, RBI had given 7 years time to repay.  This 7 years time was given within 10 days from the date of Prohibitory Order.  So there was no chance, no reason of big rush demands of any nature.
Again the same profile of investors in RNBC also that is deposit of around Rs.20,000 crores with 3 crores plus investors. Important to note that we had almost repaid all liabilities 3 years in advance in RNBC.

But all of sudden in May 2012, 1st Week, Hon’ble Supreme Court ordered for continuous hearing in June 2012 and decision had to be given the same time.

During April 2012, one news was probably infected by some interested party which spread like wild fire in our field, Countrywide that in case of Golden Forest Company which was exactly similarly initiated and fought by SEBI. After Hon’ble Supreme Court’s decision in 2004 in this Golden Forest Company for repayment, not a single rupee has been paid to any investors till today that is in 8 – 9 years. Workers and Investors also knew that there were dozens of other Companies where, SEBI’s had taken action but not a single investor have received one rupee till now.

Also, company as sole custodian of Investors money from last 34 years got concerned about Esteemed very small investors.

Then there was big rush with demands for repayments. There were big – big queues in front of offices throughout the country. We had to repay big sum but could contain to a great extent the rush by around middle of June. So almost 60% repayments had to be done in around 45 days only.  Really a very difficult time for Sahara for no fault of ours.
No fault of ours since we did this OFCD business after we got all valid permissions in writing from Central Government through Ministry of Corporate affairs as our regulator who continuously used to inspect and investigate, all Balance Sheets etc. were regularly to be submitted to them etc. etc. for last 10 – 11 years as our regulator but we faced and are facing very difficult days with retrospective effect punishments. Government departments who gave us written permission are not accused at all. Had they not given these permissions we would not have collected even one rupee and we would not have faced any problem. Well we are Prajas and they are Rajas.

One thing SEBI should understand that, had there been any hanky – panky by Sahara as accused by Chairman SEBI, then why we could not manage 5000 Crore which we have paid to SEBI.

Humble request to SEBI to act judiciously like a very responsible and very big Regulator as big brother of society.
